Apply for a contruction/fit-out permit for the factory

In case of construction of a new factory or fit-out of an existing factory for lease, the investor must apply for a construction permit.

The application documents for a construction permit include:

• An application form for a construction permit (according to the form);
• A copy or file containing the original copy of one of the documents proving the land use right as prescribed by the land law;
• Copy of detailed project drawings.
• Copy of the fire prevention and fighting certificate
• Copy of the environmental permit.

The management board of the industrial park, export processing zone, economic zone, or high-tech zone will receive the documents and issue a construction permit to the investor if the documents are valid. Otherwise, a written refusal to grant a construction permit in case the documents are not qualified.

Application for a fire prevention and fighting certificate

Stage 1: The application documents for a fire prevention and fighting certificate include:

• An application form for the fire prevention and fighting certificate (prepared according to the form);
• A certified true copy of the certificate of eligibility for fire prevention and fire fighting; a certified true copy of written acceptance of fire prevention and fighting for newly renovated or newly built establishments, motorized vehicles that need to ensure fire prevention and fighting safety when converted or built; a certified true copy of the fire prevention and fighting safety inspection record for other facilities and motor vehicles;
• A list of all means of fire prevention and fighting as well as life-saving equipment (according to the form);
• Fire fighting options;
• Decision on the establishment of the local fire prevention and fighting team;
• A list of individuals who have undergone training on fire prevention and fighting.

Stage 2: After the construction is done according to the contents that have been approved, the fire prevention and fighting police department will conduct an on-site inspection of the factory for acceptance and issue a certificate of acceptance for fire prevention and fighting.

The Investor is required to submit the above documents at the Police Department for Fire Prevention, Fighting and Rescue. In case another individual or unit is authorized to perform such submission, a written power of attorney must be attached.

Besides the above main procedures, like establishment of a business, setting up a factory also requires foreign investors to carry out some further basic procedures like paying taxes, applying for the company seal, hanging the signboard of the company, printing the invoices of the company, etc.
